Are Daily Fantasy Sports legal?
Both DraftKings and FanDuel operate under the misrepresentation that their daily fantasy sports are games of skill, not chance. The websites allow players to bet on fantasy sports teams, claiming it involves skill and thus gets around gambling laws.
In many states, a scheme is considered gambling if “chance” is the dominant factor in determining the result of the game, even though the result may be affected to some degree by skill or knowledge.
How do DFS sites work?
In traditional fantasy sports leagues, people draft their teams before the season, maintaining the same core roster for months. In contrast to season-long fantasy sports, DraftKings and FanDuel accept wagers from bettors for various sporting events, such as NFL and college football teams, as well as hockey, baseball and NASCAR, using a scheme they created that assigns values (points) based upon the performance of athletes and teams. Once the games are over, DraftKings and FanDuel calculate a score and pay bettors that have the highest total number of points, minus the companies’ average cut, which is around 6.5 percent.
Legal troubles for DraftKings and FanDuel
There have been recent actions against the two companies around the nation, including:
- An FBI probe of the companies’ business models.
- The Nevada Gaming Control Board’s order for the companies to cease operations in the state because their operations are gambling and they need a license to continue.
- The New York Office of the Attorney General sent DraftKings and FanDuel notices to cease and desist after determining the operations constituted illegal gambling in that state.
