Junk Faxes - Fight back
Heninger Garrison Davis is pursuing claims for
clients against various individuals and entities who
have violated the federal law that protects persons
and companies from junk faxes. That law is the Telephone Consumer Protection Act of 1991 (TCPA).
We have obtained settlements in the initial cases we
filed pursuant to the TCPA. Our other cases are

Unsolicited Faxes are against the law
Under the (TCPA), it is unlawful for any person
or business entity to use a telephone facsimile
machine, or other device, to send an unsolicited
advertisement to another telephone facsimile machine
without the recipient’s prior express permission or
invitation, unless the recipient has a prior
established business relationship with the sender of
the advertisement. Such an unsolicited facsimile
advertisement is called a "junk fax", and under the
TCPA, each violation is punishable by $500 to $1,500
in damages. That means that each time an individual,
company, or organization, receives just one "junk
fax", that individual, company, or organization is
entitled to $500-1,500 in compensation.
Hold Companies who use Junk Faxing Accountable
Junk faxes are annoying and abusive, and
unscrupulous persons and companies send junk faxes
everyday despite the effective penalties of the TCPA,
which are intended to punish and deter junk faxing.
In many cases, only the filing of a lawsuit will
hold junk faxers accountable for their violations of
federal law. It is very important that recipients of
junk faxes keep the faxes or make copies of them if
they wish to pursue legal action and seek statutory
remedies for violations of the TCPA.
Our Junk Fax Cases in Progress
Heninger Garrison Davis currently has three class
actions pending in the federal and state courts of
Alabama for TCPA violations. Often, in violation of
Federal Communications Commission (FCC) regulations,
junk faxes do not have the sender’s information
printed on the fax, and the only identifying
information will be the contact and removal numbers.
In those cases, our attorneys investigate until they
determine the identities of all the persons and
companies responsible for the junk faxes.
Junk Faxes - What you should do
