HGD Partner to Lead National Litigation Over Recalled Kugel Hernia Patch
HGD Partner Lew Garrison has been appointed to the Plaintiff Steering Committee by the federal judge overseeing national litigation over the recalled hernia patch manufactured by Davol, Inc., a subsidiary of the Bard Corporation. The consolidated federal litigation is based in Providence, Rhode Island, and has been assigned to U.S. District Judge Mary Lisi.
The Plaintiff Steering Committee will prosecute the claims against the manufacturer and handle all aspects of the pre-trial discovery in the case. The litigation concerns various models of the Kugel Hernia Patch, a device designed to repair hernias. The device has been recalled by the manufacturer due to failures in the plastic rings inserted in the mesh which can perforate the bowel or cause other injuries within the abdominal space. Other problems reported with the mesh are the propensity for migration and the probability that the mesh could flip over, exposing organs to the side of the mesh that can damage internal organs.
Lew Garrison has held leadership positions on steering committees for plaintiffs in other national lawsuits involving pharmaceutical and medical products.
