Big Four Pharmacy Chains Illegally Filling Prescriptions for Brand Name Medications
On September 12, 2008, HGD filed a class action lawsuit in the Bessemer Division of the Circuit Court for Jefferson County, Alabama on behalf of the State of Alabama, on behalf of a class of individual Alabama residents, and on behalf of the District Attorneys in the State of Alabama alleging that the Big Four pharmacy chains, Wal-Mart Stores, Inc., CVS Caremark Corp., Rite-Aid Corp., and Walgreen Co., Inc., routinely break the law in the state of Alabama by filling prescriptions for brand name medications with generic substitute drugs without the prescribing doctors' permission. On October 17th, 2008, the defendants removed the case to federal district court, and then on December 10, 2008, the federal district court remanded the case back to the state court, where it is today.
On June 17, 2009, HGD amended the complaint in the Bessemer Division to limit the case to encompass only the violations that occurred within the Bessemer Division and to remove the class action allegations. Within the next few weeks, HGD intends to file similar cases on behalf of the State of Alabama in at least four other Judicial Circuits in the State.
