HGD Represents Passengers in First Suit Against Southwest Airlines
Our attorney Lew Garrison has filed the first suit in the nation against Southwest Airlines for operating aircraft in violation of FAA airworthiness rules and inspection requirements. The suit quickly followed accusations of the United States Congress that Southwest endangered travelers by failing to fully inspect its aging 737 fleet for metal fatigue and other possible problems.
Congressman James L. Oberstar, who chairs the committee that investigated the critical safety lapses, accused Southwest of “putting the flying public at risk.” Oberstar also said: “It is of no consolation to say later that nobody died; there were no accidents; so everything came out all right. That is not the purpose of safety; to cross your fingers, get on the airplane and say: ‘I hope I get there safely’.”
“Southwest didn’t honor its promise to travelers and disobeyed the FAA,” Garrison explained in press coverage of the lawsuit. Articles about the suit promptly appeared in newspapers across the country and internationally.
“The airline promised as part of its contract with our clients to provide those safety inspections,” Garrison explains. “It failed to inspect and breached its contract.” Garrison adds that the passengers, had they known beforehand that the 737s were not inspected, would have chosen safety first. “No one would have chosen Southwest if they first were aware that the flight endangered their lives,” he says.
The passengers our law firm represents seek restitution and other financial relief for all Southwest ticket purchasers who traveled on aircraft that were not inspected and properly maintained. The suit is pending in federal court in Birmingham, Alabama.
