Court Cracks Down on Delays in Suboxone Cases
One of the biggest slowdowns in the Suboxone tooth decay litigation is getting medical and pharmacy records. Many pharmacies have been ignoring or delaying court orders to produce prescription histories, which are needed to prove plaintiffs used brand-name Suboxone film strips before their dental injuries. Judge Calabrese has now ordered nearly 20 noncompliant pharmacies to appear in court on August 25 to explain their delays, signaling the court’s frustration. Until these records are produced, the case selection for upcoming bellwether trials—and progress toward a possible settlement—will remain on hold.
