Early on Sunday, October 18, a 13 year old boy was shot while he slept inside his family's apartment in southeast Atlanta. It was the second time in about a year that he had been hurt by gunfire at the same complex, according to Atlanta News First and FOX 5 Atlanta.
Thankfully, he has been released from the hospital and is expected to recover. His family is now asking a question many renters ask. Who is responsible for keeping us safe where we live?
What Happened at the Atlanta Apartment Complex
The shooting happened just before 4 a.m. at the Capitol Vanira apartments off Hank Aaron Drive, FOX 5 Atlanta reported. Atlanta police told CBS News Atlanta that investigators believe the apartment was targeted with gunfire while the boy was inside.
Detectives said more than 100 shots were fired into the unit, according to Atlanta News First. The boy's mother told the station she moved her children into the bathroom and had them lie on the floor.
FOX 5 Atlanta reported that in September 2025, a drive by shooting outside the same complex wounded four young people. This boy, then 12, was one of them. After that shooting, Atlanta police placed a mobile surveillance unit in the parking lot, Atlanta News First reported. His mother told the station that the unit is not enough and that the complex has no security.
Police have not named a suspect or a motive. FOX 5 Atlanta said apartment management did not respond to requests for comment.
Why This Matters to Alabama Renters
This happened in Georgia, but the lesson reaches Birmingham, Montgomery, Huntsville and every Alabama city. Many families rent homes where they have no control over the gates, the lighting or the cameras. They count on the owner to handle those things.
The person who fires a gun is responsible for that choice. The law can also ask a second question. Did the property owner take reasonable steps to protect people from a danger it knew about?
We do not know what security this complex had in place, and we will not guess. The points below apply to any renter who has seen crime happen again and again where they live.
The Legal Issues in Plain Language
What Is Negligent Security?
Negligent security is a type of premises liability claim. It may apply when someone is hurt by a crime on a property and the owner or manager failed to take reasonable safety steps. Common examples include broken gates, locks that do not work, dark parking lots, cameras that do not record and safety complaints that go unanswered.
Was the Danger Foreseeable?
Property owners are not responsible for every crime. Courts usually look at whether the owner knew, or should have known, about a real risk of violence. A history of similar crimes on the property, police calls and written complaints from tenants can all matter. Alabama courts look closely at what the owner actually knew, so every case turns on its own facts.
Each State Has Its Own Rules
A case about an Atlanta property would follow Georgia law. A case about a property in Birmingham would follow Alabama law. The rules about who is responsible, and how much time you have to file, are different from state to state. Deadlines to file can be short.
What You Can Do to Protect Your Family
-
Report broken locks, gates, lights and cameras to management in writing, and keep a copy.
-
Keep a simple log of shootings, break ins and police calls at your complex.
-
Ask management in writing what security the property provides.
-
Before you sign a lease, ask about crime at the property and check local police reports.
-
Talk with your neighbors. Several written complaints carry more weight than one.
If You or a Family Member Is Hurt
-
Call 911 and get medical care right away.
-
Ask for the police report number and the names of the officers.
-
When it is safe, take photos of broken lights, gates, locks or doors.
-
Save the texts, emails and letters you sent to management about safety.
-
Do not post details about what happened on social media.
-
Talk with a lawyer about your rights. Deadlines to file can be short.
Frequently Asked Questions
Can I sue my apartment complex if I was shot there?
Possibly. You may have a negligent security claim if the owner knew or should have known about a risk of violence and failed to take reasonable steps to prevent it. The facts matter a great deal, including past crimes at the property and what management did about them.
What does a landlord have to do to keep tenants safe in Alabama?
In general, a landlord must use reasonable care in the areas it controls, such as common areas, parking lots, gates and lighting. Alabama law does not make a landlord responsible for every crime. A lawyer can review whether the owner had reason to expect danger and failed to act.
What evidence helps in a negligent security case?
Helpful evidence often includes police reports, records of past crimes at the property, written complaints from tenants, photos of broken security features and any video. Saving your own records early can make a big difference.
