An 11-Year Patent Lawsuit... Without a Trial
Patent litigation is rarely simple, but this case is extraordinary.
More than a decade ago, Lee and other attorneys at Heninger Garrison Davis filed a lawsuit in federal court on behalf of a client who owned two patents. The client had entered into a licensing agreement with a major international corporation, allowing the company to use his patented technology in exchange for royalty payments.
According to Lee, those payments never came.
"Our client licensed his two patents to a huge international corporation, and that corporation decided they weren't going to pay the royalties that were owed."
The lawsuit was filed 11 years ago. Yet despite years of litigation, the case has still not reached trial.
A Case Filled with Unusual Twists
As Lee explains, nearly every aspect of this case has been anything but ordinary.

Perhaps most surprising of all, the licensing agreement at the center of the dispute has still never been interpreted by the court, and no trial date has ever been set.
"It's a very complicated case, and to this day, we've never had the contract interpreted by the court, and we've never had a trial date."
For most people, that's hard to imagine. After more than a decade of legal proceedings, the central issues in the case remain unresolved.
When Delay Becomes a Strategy
Large corporations often have significant legal resources at their disposal. While every defendant has the right to defend itself, lengthy litigation can become incredibly difficult for individuals who are simply trying to enforce their rights.
Lee believes that's exactly what's happening here.
"It's denying, it's deflecting, it's delaying the case so that my client doesn't ever collect a penny of what he's owed."
